There are three ways to dissolve a marriage in Thailand:
1. Either the husband or wife dies.
2. By divorce registration.
3. By court order granting the divorce.
Divorce Registration with Mutual Consent
If you registered your marriage in Thailand, you may obtain an uncontested divorce in Thailand by appearing in person with your spouse at the registration office or at the embassy or consulate where you registered your marriage. It is a simple process that requires you to complete and sign several forms, and it usually takes less than one hour. Once completed, the documents are certified by the signatures of at least two witnesses.
You need to bring to the registration office your passport, Thai spouse’s citizen’s ID card, original marriage certificate, and a divorce contract[if any] The divorce contract is the settlement agreement between you and your spouse on how property is divided, support issues, child custody, and visitation rights.
Once you get to the registration office where you registered your marriage, inform the officer that you want to register your divorce. You will be asked the terms of your settlement for your assets, your children’s living arrangement, child support, alimony, and other matters. It is recommended that you decide this matters beforehand and record them in a divorce contact. This will expedite the process and help ensure here are no disagreements before you go to the registration office. After you fill out a reguest form and sign it, the registrar will issue a divorce certificate along with a divorce registration that contain the details of the conditions of the divorce. The process requires a minimal fee.
